First Minor's Information

  • Swimming will always be at the discretion of Whitemills Wake and Aqua Park staff and may include an assessment of ability & the requirement to wear an inflatable, brightly coloured, towfloat (loaned by Whitemills Wake and Aqua Park if required).
  • Children must be accompanied in the lake by a parent/guardian, who is a strong (not a novice) open water swimmer at all times, unless that child is a club swimmer, in which case they may swim without an adult on the recommendation of the swim club coach.
  • This agreement must be signed on behalf of a junior by a parent/guardian.

Second Minor's Information

Whitemills Wake & Aqua Park Activity Agreement

At Whitemills Wake & Aqua Park we take your health and safety seriously. We wish to highlight that any of the activities available can be potentially hazardous physical activities and that participation can lead to a risk of injury and even death.

I the Participant or Parent/Guardian of Participant(s), confirm as follows:

That I acknowledge that the activities provided by Whitemills Wake & Aqua Park require participants to be able to swim competently and to be confident in open water, to have a reasonable level of fitness and ability.

By ticking this box I confirm the participant(s) is/are (a) competent swimmer(s) and confident in deep open water, additionally, the participant(s) has/have a reasonable level of fitness and ability and would be able to exit the water without assistance.

  • I agree to swim at my own risk and I understand the dangers associated with swimming in open water, with the potential for serious personal injury, illness and damage to or loss of property.
  • I waive, release & discharge Whitemills Wake & Aqua Park, their organisers and other personnel, and will not make any claim against them.
  • That the participant(s) is/are in a good state of health and free from any injury, medical condition, disease or illness which may be aggravated by participating in activities at Whitemills Wake & Aqua Park or which may make it unsuitable for the participant(s) to take part in such activities. Additionally, the participant(s) does/do not have any medical condition that may make the activities more dangerous or may increase any risk of injury to the participant(s) or others or make more likely that the participant(s) will be involved in an accident which could result in any form injury during the activity.
  • I acknowledge and agree that the participant(s) is/are responsible for their own safety and the safety of others whilst participating in activities. I understand that the Open Water Swimming be undertaken with NO OBSERVATION OR LIFEGUARD ON DUTY following safety instructions and agree that the participant(s) will at all times wear any protective equipment provided by or required by Whitemills Wake & Aqua Park and will ensure that the participant(s) complies/comply with all instructions given at any time during the activities by Whitemills Wake & Aqua Park by any of its staff, media or signage. I further acknowledge and agree that the participant(s) will wear (a) a tow float or buoyancy aid(s) and will not remove this at any point whilst in the water.
  • I understand that any activity is reduced if the participants are educated in the activity they are undertaking, and I should increase my knowledge by using Swim England's online resources, which I can access by clicking on THIS LINK.
  • I understand that the decision to allow non-wetsuit swimming rests with Whitemills Wake & Aqua Park. If I choose to swim without a wetsuit I will advise the organisers.
  • I understand that when the water is under 12°C wetsuits are mandatory and have to be worn.
  • I understand that swimming in colder waters can cause Cold Water Shock and exposure should be reduced, especially if any participants are slowing down or struggling, they should exit the water immediately to reduce the risk of swim failure.
  • I understand that the decision to cancel or postpone swimming with regard to water temperature, visibility, weather conditions or other related matters rests with Whitemills Wake & Aqua Park.
  • I will not enter the water until I have signed in, paid the swim fee & been advised by the organisers that I may do so.
  • I will enter or exit the water within the times stipulated by the organisers and/or when advised by the organisers/safety personnel.
  • I will enter and exit the lake at the specified Entry/Exit Point, unless in an emergency.
  • I understand that the lake is shallow at the bank and diving in is prohibited and will advise any participants under the age of 18 of this.
  • I acknowledge that the lake is up to 2.5 METERS DEEP with a gradient of 1:4, which is steeper than a swimming pool, and will advise any participants under the age of 18 years. Additionally, I will not advise non-swimmers to enter an environment such as at Whitemills Wake and Aqua Park, as it is not suitable for them.
  • I understand that I and other participants MUST stick to the Open Water Swim course, and will ensure any participants under 18 years I am supervising MUST also do so.
  • I understand their are no lifeguards on duty, so swimming with a buddy will greatly increase my safety, and the risks of drowning are significantly increase by not doing so. Also, participants under 18 are not permitted to swim without a buddy.
  • I understand that novice Open Water Swimmers MUST declare their status, have a buddy and not swim too far from the bank.
  • If I get in to trouble, I understand that participants should hold onto their tow float, shout and raise their other hand to raise the alarm, and I will ensure any participants under 18 are informed of this.
  • Upon exit, I will check-out with the attendant to confirm my safe exit of the lake.
  • I understand when swimming in open water that hygiene is very important and all participants should show afterwards and clean any cuts.
  • I agree that the participant(s) shall not participate in any activities provided by Whitemills Wake & Aqua Park unless the participant(s) has/have undertaken Whitemills Wake & Aqua Park’s safety and induction procedures and processes in relation to the activities and confirm that the participant(s) will comply with these at all times whilst on the premises from which the activities will be carried out.
  • I agree and promise to ensure the participant(s) accept(s) to be responsible for any and all risks existing and subsisting in the activities. I acknowledge that participation in the activities is voluntary and that the participant(s) elect(s) to participate despite of the risks and agrees to accept the consequences of so doing.
  • That the participant(s) will not use Whitemills Wake & Aqua Park’s facilities and activities whilst under the influence of any drugs or alcohol.
  • That I will fully indemnify Whitemills Wake & Aqua Park, its agents and employees against any claim brought by a third party for loss, damage, injury or death which has been caused by any action or omission of mine or any act or omission of any participant(s) of which I am the lawful parent or guardian or any participant(s) whose supervision is wholly or partly my responsibility at the time of the relevant act or omission that would, if they had agreed to the same with full capacity to do so, amount to a breach of these Terms and Conditions or which amounts to negligence or a wilful act or omission.
  • That when accompanying a child or children under the age of 14 years, I will comply and ensure that the child or children are safe and looked after. I will be present on site at all times and will not leave them unattended.
  • I confirm and agree that the participant(s) will comply with all age and height restrictions specified by Whitemills Wake & Aqua Park from time to time. The participant(s) acknowledge(s) that if they do not comply with any age or height restrictions or any other requirements put in place by Whitemills Wake & Aqua Park from time to time, they will not be able to participate in the activities and agree that they will promptly withdraw upon request by Whitemills Wake & Aqua Park.
  • Participant(s) should not enter the water if they are suffering from gastrointestinal illness, and if they have been recently unwell, they must be symptom free for 48 hours before they can use the facility.
  • I acknowledge that nothing in these Terms and Conditions is intended to avoid liability, on the part of Whitemills Wake & Aqua Park, for personal injury or death caused by the negligence of wilful act of its authorised person or agents.
  • I and as parent or legal guardian of any accompanying children give consent and agree to Whitemills Wake & Aqua Park photographing and/or recording(s) myself and any accompanying children and to use any such photographs and/or recording solely and only for Whitemills Wake & Aqua Park advertising and promotional purposes. Myself and any accompanying minors hereby waives any right to inspect or approve the use of any such material and acknowledge and agree that the rights to use such material shall not require payment or compensation of any kind to be made by Whitemills Wake & Aqua Park to myself and/or any accompanying children. I am fully aware that I must contact a manager of Whitemills Wake & Aqua Park if I do not wish to be a part.
  • The participant(s) consent(s) and agree(s) to the use by Whitemills Wake & Aqua Park of CCTV monitoring for training, health and safety and security purposes.
  • Whitemills Wake & Aqua Park consents to the participant(s) and accompanying members of their group undertaking photography for their own non-commercial purposes only and for no other purpose whatsoever. However, the participant(s) and accompanying members of their group are not to use any drone type equipment at Whitemills Wake & Aqua Park, without seeking the correct permit(s), having the required training, license(s) and insurance, with supporting documentation being available, to operate the equipment, before seeking the approval of the senior management at Whitemills Wake & Aqua Park.
  • The participant(s) acknowledge(s) that Whitemills Wake & Aqua Park is not and shall not be liable for any damage or loss to themselves, any third parties or property incurred whilst the participant(s) is/are undertaking the activities or are on the premises of Whitemills Wake & Aqua Park.
  • That I may be asked for proof of I.D at any age. I must be able to produce documents if necessary. Failure to do so can result in being refused to partake in activities.
  • I confirm that I have read the above and adhere to the guidance set by the staff.
  • I confirm I am over the age of 18 years, signing for myself as a participant or as the Parent/Guardian of (a) participant(s) under the age of 18 years old.
